In almost all car accident cases, traffic accident lawyers charge their clients on a contingency basis. This means that accident victims will not pay attorneys’ fees unless their attorney helps them recover the money for their losses.

When car accident attorney fees are billed on a contingency basis, they are charged as a percentage of the compensation the victim receives.

The specific percentage may vary depending on whether the case is resolved by settlement or goes to trial. It is usually between 25% and 40%, with most attorneys charging around 33%. A lawyer can charge 25% if the case settles quickly, for example, or up to 40% if a long trial is needed because of the complexity of the case or because the defendant is appealing the decision.

If you received $250,000 in your case, that could mean you will only pay $62,500 if your case is resolved quickly or up to $100,000 if an extended trial is needed.

These charges are for legal fees only – expenses are additional charges and are billed separately.

Note that all reputable attorneys provide you with a written contract for their services that specifies their fees and what you must pay. If you don’t receive a written contract, ask for one.
